With regards to the MT bike path, who owns the property where this is going? Do residents own it and AC Electric has an easement or is it the other way around? If ACE has an easement, they might not be able to assign a right of way for the bike path. I know of a Pennsylvania case where a railroad obtained an easement from individual property owners. They built their railroad and started assigning rights of ways for utilities to string wires, etc. The railroad had no such right to do this. Their easement was for a specific purpose, to build a railroad only. Maybe this should be looked into.
Moderator's Note: The electric company owns the right of way. The company enters an agreement with the township to allow the bike path, as in Court House along the high-lines. In Rio Grande, the owners have been paying the electric company a rental fee for many decades, and are also required to maintain liability insurance to cross that right of way, for their driveways.
