From my research 4 elements are required before conspiracy charges can be brought. 1)An agreement between at least 2 parties. 2) The agreement is meant to achieve an illegal goal. 3) All parties alleged to have participated in the conspiracy must have had knowledge of the conspiracy and participated in some way. 4) At least 1 person involved in the conspiracy has to have made an overt act to further the goals of the conspiracy. In a random example, if someone were to take an intelligence report that stated one thing, and changed it to say something completely different? That is an overt act.
