If they don’t include the fee in their gross, but still deduct the fee someone else actually paid for them, that’s cheating on your taxes (padding deductions). However, they do pay the 3% on the 3% that was charged, so they can deduct that, complicating matters. If POS displays % on each receipt you can separate.
